Welcome to the Big Daddy’s Liquors Good Customer Rewards Program, a program designed to offer valued customers an opportunity to earn $20 Big Daddy’s Liquors Good Customer Gift Cards, redeemable at all Flanigan’s Seafood Bar and Grill restaurants, as they shop. Use of the Big Daddy’s Liquors Good Customer Reward Card constitutes each member’s acceptance of the following terms and conditions.
1. Big Daddy’s Liquors Good Customer Points are available on purchases at all Big Daddy’s Liquors package liquor stores. You must present your Big Daddy’s Liquors Good Customer Reward Card or your telephone number at the time of purchase to earn your points.
2. No purchase is necessary to get a Big Daddy’s Liquors Good Customer Reward Card, however you may only have one (1) active card at a time and you must complete our short application at any of our Big Daddy’s Liquors locations to qualify. Lost or stolen cards will be replaced, but Big Daddy’s Liquors is not responsible for points earned or lost on misplaced or stolen cards.
3. You will earn one (1) point for every $25.00 purchase on a single receipt at any Big Daddy’s Liquors location, excluding lottery purchases and Florida sales tax. For example, purchases of $24.99 or less will not earn any points; purchases of $25.00 – $49.99 will receive one (1) point; purchases of $50.00 – $74.99 will receive two (2) points; purchases of $75.00 – $99.99 will receive three (3) points and so forth without limitation. Your receipt after each purchase will confirm the points earned and the total amount of points in your account. Big Daddy’s Liquors Good Customer points have no cash value.
4. If a member returns merchandise for which point(s) were earned, said member’s point status may be adjusted, (a deduction of points may occur), to reflect the return.
5. Each time your account reaches 10 points, the points will automatically be deducted and a $20 Big Daddy’s Good Customer Gift Card will be issued at the Big Daddy’s Liquors location where and at the time your account reaches 10 points. To receive your $20 Big Daddy’s Good Customer Gift Card you will need to provide either (1) your Big Daddy’s Good Customer Card, knowing the name and telephone number on the account and present photo identification; or (2) you will need to know the name and telephone number on the account and present photo identification. The $20 Big Daddy’s Good Customer Gift Card may be redeemed at any Flanigan’s Seafood Bar and Grill restaurant for food and beverages.
6. Your points will be credited to your account at the time of purchase and you will be able to check your account balance by contacting Flanigan’s corporate office at 954-377-1961, Monday through Thursday. Your card will be activated upon joining, but please allow up to seven (7) days after joining for us to update your enrollment information.
7. Members recognize that the Big Daddy’s Good Customer Rewards Program, including any of its benefits, are property of Big Daddy’s Liquors and not property of the members. Members shall also have no ownership rights in points that have accumulated in his/her membership account, until said points are disbursed to the member through the issuance of a $20 Big Daddy’s Good Customer Gift Card.
8. Members recognize that the Big Daddy’s Liquors Good Customer Rewards Program, including any of its benefits, are property of Big Daddy’s Liquors and not property of the members. Members shall also have no ownership rights in points that have accumulated in his/her membership account, until said points are disbursed to the members through the issuance of a $20 Big Daddy’s Good Customer Gift Card.
9. Big Daddy’s Liquors reserves the right , in its sole discretion, to terminate the Big Daddy’s Good Customer Rewards Program, and to alter, limit, modify or add to the Big Daddy’s Good Customer Rewards Program terms and conditions, including but not limited to imposing time limits and changes in point values and reward levels, all without prior notice at any time. All modifications to the Big Daddy’s Good Customer Rewards Program will be posted at www.bigdaddysliquors.com and shall become effective when posted. A member’s continued use of his/her Big Daddy’s Good Customer Rewards Card after a change has been posted or gone into effect, constitutes acceptance of the change to the Big Daddy’s Good Customer Rewards Program.
10. Big Daddy’s Liquors reserves the right to deny or limit membership to the Big Daddy’s Good Customer Rewards Program for any reason or no reason.
11. Big Daddy’s Liquors reserves the right to discontinue membership privileges and/or void all or a portion of a member’s point balance if the points have been issued, received or redeemed through computer error, fraud or theft, through illegal means or in a manner not authorized in these terms and conditions or in other legal or equitable remedy which may be available to the Big Daddy’s Good Customer Rewards Program under applicable law.
12. Big Daddy’s Liquors may send e-mails to Big Daddy’s Liquors Good Customer members from time to time, with discount offers or information about our Big Daddy’s Liquors Good Customer Reward Program. Our list of Big Daddy’s Liquors Good Customer members will not be shared with any organization which is not affiliated with Big Daddy’s Liquors.
13. Employees of Big Daddy’s Liquors and their immediate families are not eligible to participate in the Big Daddy’s Good Customer Rewards Program.
14. Big Daddy’s Liquors Good Customer Reward Cards unused for a period of one (1) year will be automatically cancelled and all points will be forfeited. Unredeemed points shall expire 12 months from the date they were earned, even if there is account activity during the past 12 month period.
15. Big Daddy’s Liquors, its affiliates, agents and employees make no representations, warranties or conditions of any kind, express or implied, with respect to the Big Daddy’s Good Customer Rewards Program or each member’s account, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement, or any warranty arising by usage of trade, course of dealing or course of performance. In the event Big Daddy’s Liquors, its affiliates, agents and employees is found liable to you, you shall only be entitled to recover actual and direct damages. Big Daddy’s Liquors, its affiliates, agents and employees shall have no liability for any incidental, indirect or consequential damages arising out of or in any way connected with Big Daddy’s Good Customer Rewards Program, whether in contract, warranty, tort, product liability, strict liability or other theory. In no event shall Big Daddy’s Liquors, its affiliates, agents and employees have any liability for unauthorized access to or alteration, theft or destruction of Big Daddy’s Good Customer Rewards Card accounts through accident, misuse or fraudulent means or devices by members or any third party, or as a result of any delay or mistakes resulting from any circumstances beyond Big Daddy’s Liquor’s control. Any liability Big Daddy’s Liquors may have to a member shall be limited to $100.00, provided that if Big Daddy’s Liquor’s liability is limited by state or local law, such liability shall be limited to the greatest extend permitted by law.
16. Miscellaneous:
a. These terms and conditions are binding on each member as long as he/she participates in the Big Daddy’s Good Customer Rewards Program. These terms and conditions are also binding after a member’s membership is terminated as to any issue or transaction that occurred during his/her participation in the Big Daddy’s Good Customer Rewards Program.
b. The Big Daddy’s Good Customer Rewards Program is void where prohibited by federal, state or local law.
c. Any dispute relating to the Big Daddy’s Good Customer Rewards Program shall be governed by the laws of the State of Florida and venue shall be in the state courts in Broward County, Florida.
d. These terms and conditions represent the entire agreement between Big Daddy’s Liquors and each member and supersede any other agreements, statements or representations.
e. In the event that any provision of these terms and conditions shall be determined to be illegal or unenforceable, that provision will be eliminated to the minimum extent necessary so that the terms and conditions shall otherwise remain in full force and effect and enforceable.
